These Terms and Conditions apply to purchases made through eaperformance.com.au and directly from Elden’s Autobahn / EA Performance. By placing an order, you agree to these terms. Nothing in these terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.

PRODUCT INFORMATION AND FITMENT
We take reasonable care to provide accurate product descriptions, images, prices and vehicle fitment information. Vehicle compatibility may vary by build date, model year, body style, engine, drivetrain, transmission, market, emissions equipment and factory options. Product images may occasionally be representative where stated. The website’s Year/Make/Model finder and other fitment information are guides only.
You are responsible for checking the product description, part number, selected configuration and complete vehicle compatibility before ordering. If you are unsure, contact us before checkout with the VIN, build date and full vehicle specification. Any fitment recommendation we provide is based on the information supplied to us and can only be as accurate as that information. If we give incorrect written fitment advice despite receiving complete and accurate details, we will assess and resolve the matter in accordance with the Australian Consumer Law.
Some performance products may affect noise, emissions, roadworthiness, insurance, manufacturer warranty or legal use. Products described as race, competition, cat-delete, GPF/OPF-delete or similar may not be legal for public-road use. The customer is responsible for confirming applicable laws and intended use.
PRICES, GST AND CURRENCY
Unless stated otherwise, website prices are shown in Australian dollars and include GST where applicable. Delivery, installation and other optional charges are shown separately before checkout. Currency conversion tools are indicative only; the final charged amount is determined by the selected checkout currency and payment provider.
We may correct genuine pricing, typographical or technical errors. If an error affects an order already placed, we will contact you before supply and offer the option to proceed at the correct price or receive a refund.
ORDERS AND ACCEPTANCE
Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt but does not guarantee acceptance or availability. We may decline or cancel an order before dispatch where a product is unavailable, incorrectly priced, affected by a supplier error, restricted for delivery, or reasonably suspected of fraud. If we cannot accept an order, we will refund amounts paid for the affected item.
PAYMENT
Full payment must be received and cleared before we commit to or place an order with a manufacturer, distributor or supplier, unless we agree otherwise in writing. Online card payments are processed through eWAY. PayPal and WooPayments are not accepted at checkout. We may hold an order until payment has cleared and security checks are complete. You confirm that you are authorised to use the selected payment method.
AVAILABILITY, BACKORDERS AND SPECIAL ORDERS
Automotive parts sold by EA Performance are generally sourced or ordered from the manufacturer, distributor or supplier specifically to fulfil the customer’s order. Stock and supplier availability are updated in good faith but can change without notice. We will advise you if an item is delayed or unavailable and provide the options required by law.
Once we have placed the order with the supplier, the product generally cannot be changed, cancelled, returned or refunded for change-of-mind reasons. This applies to made-to-order, custom-made, imported, specially configured and other supplier-ordered parts. Supplier lead times are estimates unless we expressly guarantee a date in writing. Nothing in this section limits rights that cannot lawfully be excluded under the Australian Consumer Law.
SHIPPING AND DELIVERY
Delivery estimates are estimates only and may be affected by supplier lead times, customs, carriers, weather and events outside our reasonable control. Please provide a complete and accurate delivery address. Additional carrier charges caused by an incorrect address, failed delivery or redirection may be passed on where permitted by law.
Inspect deliveries promptly and retain the packaging. Report visible freight damage, missing items or an incorrect delivery as soon as possible with your order number and photographs. Do not install a product that appears damaged or incorrect.
ORDER CHANGES, CANCELLATIONS AND RETURNS
Contact us immediately if you need to change or cancel an order. If the supplier order has not yet been placed, we may agree to an amendment or cancellation at our discretion and will confirm any approval in writing. Once the supplier order has been placed or accepted, we do not offer voluntary cancellation, return, exchange, store credit or refund for change of mind or customer ordering error.
Customer ordering error includes selecting the wrong part or configuration, supplying incomplete or incorrect vehicle information, changing the vehicle or intended use, deciding not to install the product, finding a lower price elsewhere, or no longer wanting the product. These restrictions do not apply where the goods fail a consumer guarantee or we supplied goods that do not match the confirmed order.

AUSTRALIAN CONSUMER GUARANTEES
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Depending on the circumstances, you may be entitled to a repair, replacement, refund, repeat service, cancellation and/or compensation for reasonably foreseeable loss or damage.
You do not have to deal with a manufacturer instead of us. We may work with the manufacturer or supplier to assess and resolve a claim, but this does not remove our obligations as the seller.
INSTALLATION AND USE
Professional installation is strongly recommended for performance and safety-critical components. Unless installation is included in your order, product prices do not include fitting, tuning, coding, alignment, calibration, consumables or related workshop work.
Damage caused by incorrect installation, misuse, unauthorised modification, competition use outside the product’s specification, failure to follow instructions or incompatibility caused by undisclosed vehicle modifications may not be covered by a voluntary manufacturer warranty. This does not limit rights that apply under the Australian Consumer Law.
MANUFACTURER WARRANTIES
Some products include a manufacturer warranty in addition to your statutory rights. Warranty periods and conditions vary by brand and product. Any manufacturer warranty operates alongside, and does not replace, your Australian Consumer Law rights.
WEBSITE USE AND INTELLECTUAL PROPERTY
Website content, branding, text, graphics and layout are owned by or licensed to us and may not be reproduced commercially without permission. Supplier names, trademarks and product images remain the property of their respective owners.
You must not misuse the website, attempt unauthorised access, introduce malicious code, scrape it in a way that materially disrupts service, or use it for unlawful activity.
PROMOTIONS AND DISCOUNTS
Promotions, coupon codes and discounts are subject to their stated dates, eligibility and exclusions. Unless stated otherwise, offers cannot be combined. We may withdraw or correct a promotion affected by a genuine error, while honouring any rights that have already arisen under law.
PRIVACY
We handle personal information in accordance with our Privacy Policy. Information may be shared with payment providers, delivery carriers, suppliers and service providers where reasonably necessary to process and fulfil an order.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, we are not responsible for indirect or consequential loss that was not reasonably foreseeable or caused by matters outside our reasonable control. Nothing in these terms limits liability or remedies that cannot lawfully be limited, including rights under the Australian Consumer Law.
CHANGES TO THESE TERMS
We may update these terms from time to time. The terms displayed when you place an order apply to that order, unless a change is required by law or agreed with you.
GOVERNING LAW
These terms are governed by the laws of Queensland, Australia. The parties submit to the courts and tribunals with jurisdiction in Queensland, without limiting any rights you may have to bring a claim elsewhere under applicable consumer law.
