Special-order parts: no change-of-mind returns

EA Performance / Elden’s Autobahn supplies automotive parts that are sourced or ordered from the manufacturer, distributor or supplier specifically to fulfil each customer order. We do not offer voluntary returns, refunds, exchanges or store credit for change of mind or customer ordering errors.

This includes, without limitation, ordering the wrong part or configuration, providing incorrect or incomplete vehicle details, changing your vehicle or plans, deciding not to proceed with installation, finding a lower price elsewhere, or deciding that the product is no longer wanted. It also applies to custom-made, made-to-order, imported, specially configured and supplier-ordered products.

Nothing in this policy excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

Payment and supplier orders

Payment must be received and cleared in full before we commit to or place an order with a manufacturer, distributor or supplier, unless we agree otherwise in writing. Once the supplier order has been placed or accepted, it cannot generally be changed or cancelled and no change-of-mind refund will be available.

If you contact us before the supplier order has been placed, we may agree to a cancellation or amendment at our discretion. Any approval must be confirmed by us in writing.

Fitment and customer responsibility

Before ordering, you must check the full product description, part number, configuration and vehicle compatibility. Vehicle fitment can vary by build date, model year, body style, engine, drivetrain, transmission, market, emissions equipment and factory options. The website’s Year/Make/Model finder and other fitment information are guides only.

If you are uncertain, contact us before checkout with the vehicle identification number (VIN), build date and complete vehicle specification. A recommendation can only be as accurate as the information you provide.

A part ordered from the information selected or supplied by the customer is not faulty merely because it does not fit a different vehicle or specification. However, if we supplied an item that does not match the confirmed order, or our written fitment advice was incorrect despite you providing complete and accurate vehicle details, contact us and we will assess and resolve the matter in accordance with the Australian Consumer Law.

Australian Consumer Law

Our goods come with consumer guarantees that cannot be excluded under the Australian Consumer Law. Where a product has a major failure, you may be entitled to reject it and choose a refund or replacement. For a failure that is not major, we are entitled to provide an appropriate repair or replacement within a reasonable time. Other remedies may apply depending on the circumstances.

Change of mind, accidental ordering, misuse, incorrect installation, damage after delivery, or a problem caused by undisclosed vehicle modifications does not by itself create a right to a refund. These exclusions do not apply where the product otherwise fails a consumer guarantee.

Faulty, damaged, misdescribed or incorrect products

If a product is damaged in transit, incorrect, misdescribed or may be faulty, contact us as soon as reasonably possible with your order number, a description of the issue and clear photographs. Do not install, modify or use a product that appears damaged or incorrect.

We may inspect the product and, where appropriate, obtain a technical assessment from the manufacturer or supplier before confirming the remedy. You do not have to deal with the manufacturer instead of us; any manufacturer assessment is part of our process as the seller.

Where a consumer-guarantee failure or our supply error is confirmed, we will provide the remedy required by law and cover or reimburse reasonable return costs where required. Manufacturer warranties operate in addition to, and do not replace, your statutory rights.

Lead times and availability

Supplier lead times and delivery dates are estimates unless we expressly guarantee a date in writing. Manufacturing, international freight, customs and supplier delays can occur. A reasonable delay does not convert a special-order purchase into a change-of-mind return, although your rights under the Australian Consumer Law continue to apply if we cannot supply within the required or a reasonable time.

Freight damage

Inspect deliveries promptly and retain all packaging. Photograph any visible damage to the product, packaging and shipping label, and contact us before installation so the freight claim can be assessed.

How to make a claim

Contact us before returning anything so we can provide the correct return address and instructions. Unauthorised returns may be refused or delayed where permitted by law.
